1. Acceptance of Terms
By accessing or using the ClearPaw website (clearpaw.io) or any ClearPaw services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services. These terms apply to all visitors, users, and others who access or use the service.
2. Description of Services
ClearPaw provides a white-labeled veterinary telehealth and practice management SaaS platform for independent veterinary practices. Services include AI symptom triage, after-hours virtual consults, prescription refill management, client communication tools, digital health records, and analytics. Service availability and features may vary by subscription plan.
3. Subscription and Payment
ClearPaw offers monthly and annual subscription plans. By subscribing, you agree to pay the applicable fees as described on our Pricing page. Monthly subscriptions are billed on a recurring monthly basis. Annual subscriptions are billed upfront for a full year. All fees are non-refundable except as described in our 30-day free trial policy. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.
4. Free Trial
New subscribers may access a 30-day free trial with full platform access. No credit card is required to start a trial. If you are not satisfied within the first 30 days of a paid subscription, contact us for a refund of your first month's payment.
5. Acceptable Use
You agree to use ClearPaw only for lawful purposes and in accordance with these Terms. You agree not to: • Use the service in any way that violates applicable laws or regulations • Transmit any unsolicited or unauthorized advertising or promotional material • Attempt to gain unauthorized access to any part of the service • Use the service to store or transmit malicious code • Interfere with or disrupt the integrity or performance of the service
6. Data and Privacy
Your use of ClearPaw is also governed by our Privacy Policy. You retain ownership of all data you input into the platform. ClearPaw processes your data solely to provide our services. For veterinary practices subject to HIPAA, ClearPaw will execute a Business Associate Agreement upon request.
7. Intellectual Property
The ClearPaw platform, including its software, design, and content, is owned by ClearPaw LLC and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the platform for your practice's internal business purposes. White-label customizations (your logo, colors, domain) remain your property.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLEARPAW SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. ClearPaw's total liability for any claim arising from these Terms shall not exceed the amount you paid to ClearPaw in the 12 months preceding the claim.
9. Termination
Either party may terminate the service relationship at any time. ClearPaw reserves the right to suspend or terminate your access for violation of these Terms. Upon termination, you may request an export of your data within 30 days. After 30 days, ClearPaw may delete your data in accordance with our data retention policy.
10. Governing Law
These Terms shall be governed by the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Pasco County, Florida.
